Introduction

Loyal Patron LLC (DBA The Birthday CLUB) takes your right to privacy seriously, and wants you to feel comfortable using our service, website and mobile app and providing your contact information. This privacy policy deals with personally identifiable information (referred to as “data” below) that may be collected from you. This policy does not apply to other entities that are not owned or controlled by The Birthday CLUB, nor does it apply to persons that are not employees or agents of the app administrator, or that are not under the app administrator’s control. By downloading the app and creating an account you confirm that you have read, understand and agree to this Privacy Policy & Terms of Service which will constitute a legally binding agreement between us ("Agreement") and that your usage shall conform to this Agreement.

1. Authentication Services 

We support login via Email, Facebook, Google, and Sign in with Apple. With Sign in with Apple, you may choose to keep your email private. We only receive an Apple‑generated proxy email. All login options collect only your name and email and do not track your in-app behavior for any purpose, including advertising, without your explicit consent.

2. Collection of Data

We collect personal information that you voluntarily provide when you register for and use The Birthday CLUB mobile application (“App”). This information includes your name, email address, date of birth (month and day), and mobile phone number.

Providing certain personal information, including a mobile phone number, is required to create an account and access the App. If required information is not provided, registration cannot be completed and the App will not be accessible.

Your mobile phone number is used to help maintain account integrity, prevent duplicate registrations, and protect the security of promotions and offers available within the App. Your phone number is not used for marketing or text messaging purposes unless you explicitly opt in to receive SMS communications.

We may also automatically collect limited technical information when you use the App, such as device identifiers, operating system information, and usage data, to operate, maintain, and improve the App’s functionality and user experience.

3. Use of Collected Data

We use the personal information we collect to operate, maintain, and improve The Birthday CLUB mobile application and to deliver its core functionality. Specifically, we may use your information to:

• Create and manage your account and enable access to the App
• Verify account uniqueness, maintain account integrity, and prevent duplicate registrations
• Deliver birthday-related and promotional offers available within the App
• Communicate with you regarding your account, including service related or transactional notifications
• Respond to user inquiries, requests, or support needs
• Monitor usage trends and improve App performance, features, and user experience
• Comply with applicable legal, regulatory, and contractual obligations

Your mobile phone number is used for internal account-related purposes such as account verification and integrity controls. We do not send marketing or promotional text messages unless you have explicitly opted in to receive SMS communications, and you may opt out of such messages at any time.

We do not use personal information for cross-app tracking, targeted advertising, or sale to third parties.

4. Access to Personally Identifiable Information (PII) 

In addition to messages sent to users directly from The Birthday CLUB we provide access to your PII (Name, Email, Birthday Month/Day, Mobile) to only those Advertisers whom you patronize by redeeming a deal available in the app at checkout to complete a sales transaction. We provide this non-financially sensitive marketing data to advertisers to aid in reconciliation controls to help prevent redemption abuse of deals The Birthday CLUB makes available to its users. Although unlikely, it is possible advertisers may use this marketing information to send you information about offers and services they feel would be of interest to you outside of The Birthday CLUB app. You can elect to stop receiving email and/or text messages directly from participating advertisers by unsubscribing to messages received directly from the communicating advertiser. 

5. Security

We maintain rigorous Security Practices to ensure as much as is reasonably possible that the confidentiality of your PII is not compromised. The Birthday CLUB has established company-wide security practices for your protection. These practices include, but are not limited to, firewall security, the use of appropriate encryption technology, and the use of multiple levels of credential security to limit access to data on a "need to know" basis. All contractors and employees are required to familiarize themselves with, and abide by, these safeguards.

6. Minors

Although The Birthday CLUB promotes family friendly content the app administrator does not make the app available for download to minors under age 17. For more information, please contact the app administrator.

7. Changes to this Privacy Policy

Changes may be made to this policy from time to time. You will be notified of substantial changes to this policy either by the posting of a prominent announcement on the site, and/or by a mail message sent to the e-mail address you have provided, which is stored within your user settings. You understand the most recent version of this Agreement will be available herein. 

8. NO GUARANTEES

While this privacy policy states standards for maintenance of data, and while efforts will be made to meet the said standards, the app administrator is not in a position to guarantee compliance with these standards. There may be factors beyond the app administrator’s control that may result in disclosure of data. Consequently, the app administrator offers no warranties or representations as regards maintenance or non-disclosure of data.
