Introduction

Loyal Patron LLC (DBA The Birthday CLUB) takes your right to privacy seriously, and wants you to feel comfortable using our service, website and mobile app and providing your contact information. This privacy policy deals with personally identifiable information (referred to as “data” below) that may be collected from you. This policy does not apply to other entities that are not owned or controlled by The Birthday CLUB, nor does it apply to persons that are not employees or agents of the app administrator, or that are not under the app administrator’s control. By downloading the app and creating an account you confirm that you have read, understand and agree to this Privacy Policy & Terms of Service which will constitute a legally binding agreement between us ("Agreement") and that your usage shall conform to this Agreement.

1. Authentication Services 

We support login via Email, Facebook, Google, and Sign in with Apple. With Sign in with Apple, you may choose to keep your email private. We only receive an Apple‑generated proxy email. All login options collect only your name and email and do not track your in-app behavior for any purpose, including advertising, without your explicit consent.

2. Collection of Data

Registration or submission requires your name, a valid e‑mail address, and your birthday month and day. You may register with Email, Facebook, Google, or Sign in with Apple. Your birthday (month and day) is essential for sending you personalized birthday offers and experiences. We do not collect your birth year unless required for legal age verification. You are not required to provide any other personal information. Participation in The Birthday CLUB app is limited to one individual per account (unique user). You agree to provide only true and accurate information when signing up for the app or updating personal details at all times.

Please note that the email address and any information you provide during registration may identify you personally and may be displayed within the app, depending on your selected settings or how the app is configured. As with most apps, we may also automatically collect standard log data such as your IP address. While we take reasonable measures to secure your data, unauthorized access (e.g., due to third-party intrusion) could result in unintentional disclosure.

3. Use of Collected Data

We use your birthday (month and day) exclusively to send you relevant offers, reminders, and personalized birthday celebrations. We do not use your birthday for marketing purposes unless you explicitly opt in, and we do not share this information with third parties except as described in this policy.

The Birthday CLUB may send periodic messages via email, text message, or in-app notifications, based on your notification preferences, which you can manage at any time from your user profile settings. We may use your data to personalize and improve your experience within the app, including customizing content and offers based on your interests.

We may also supplement your profile with publicly available or commercially obtained data to help us provide more relevant gift-giving, gift-receiving, or money-saving celebration opportunities. This additional data is only used for internal comparison and personalization purposes, and is not shared externally without your consent.

We will not make your data available to third parties unless:

1. You have given explicit consent (e.g., by opting in to data sharing),
2. A third party is directly involved in delivering a service you’ve requested (such as an application service provider),
3. Required by law or legal process,
4. Necessary to enforce our terms of service or protect our legal rights or property,
5. The app is acquired by another entity, in which case your data may transfer under the same terms of this policy.

If you choose to follow links to third-party apps or websites from within The Birthday CLUB, please review their privacy policies, as we are not responsible for their data practices.

4. Access to Personally Identifiable Information (PII) 

In addition to messages sent to users directly from The Birthday CLUB we provide access to your PII (Name, Email, Birthday Month/Day, Mobile) to only those Advertisers whom you patronize by redeeming a deal available in the app at checkout to complete a sales transaction. We provide this non-financially sensitive marketing data to advertisers to aid in reconciliation controls to help prevent redemption abuse of deals The Birthday CLUB makes available to its users. Although unlikely, it is possible advertisers may use this marketing information to send you information about offers and services they feel would be of interest to you outside of The Birthday CLUB app. You can elect to stop receiving email and/or text messages directly from participating advertisers by unsubscribing to messages received directly from the communicating advertiser. 

5. Security

We maintain rigorous Security Practices to ensure as much as is reasonably possible that the confidentiality of your PII is not compromised. The Birthday CLUB has established company-wide security practices for your protection. These practices include, but are not limited to, firewall security, the use of appropriate encryption technology, and the use of multiple levels of credential security to limit access to data on a "need to know" basis. All contractors and employees are required to familiarize themselves with, and abide by, these safeguards.

6. Minors

Although The Birthday CLUB promotes family friendly content the app administrator does not make the app available for download to minors under age 17. For more information, please contact the app administrator.

7. Changes to this Privacy Policy

Changes may be made to this policy from time to time. You will be notified of substantial changes to this policy either by the posting of a prominent announcement on the site, and/or by a mail message sent to the e-mail address you have provided, which is stored within your user settings. You understand the most recent version of this Agreement will be available herein. 

8. NO GUARANTEES

While this privacy policy states standards for maintenance of data, and while efforts will be made to meet the said standards, the app administrator is not in a position to guarantee compliance with these standards. There may be factors beyond the app administrator’s control that may result in disclosure of data. Consequently, the app administrator offers no warranties or representations as regards maintenance or non-disclosure of data.
