This Privacy Policy describes how we collect, use, protect, and share personally identifiable information (referred to as "data" below) that may be collected from you through The Birthday CLUB mobile application ("App") and website at https://thebirthdayclub.app ("Site") (collectively, the "Services").

This policy does not apply to other entities that are not owned or controlled by The Birthday CLUB. By downloading the App and creating an account you confirm that you have read, understood, and agree to this Privacy Policy, which constitutes a legally binding agreement between us. Your usage of the Services shall conform to this agreement.

1. AUTHENTICATION SERVICES

We support login via Email, Facebook, Google, and Sign in with Apple. With Sign in with Apple, you may choose to keep your email private — we only receive an Apple-generated proxy email. All login options collect only your name and email address and do not track your in-app behavior for any purpose, including advertising, without your explicit consent.

2. COLLECTION OF DATA

We collect personal information that you voluntarily provide when you register for and use the App. This information includes your name, email address, date of birth (month and day), and mobile phone number.

Providing certain personal information, including a mobile phone number, is required to create an account and access the App. If required information is not provided, registration cannot be completed and the App will not be accessible.

Your mobile phone number is used to help maintain account integrity, prevent duplicate registrations, and protect the security of promotions and offers available within the App. Your phone number is not used for marketing or text messaging purposes unless you explicitly opt in to receive SMS communications.

We may also automatically collect limited technical information when you use the App, such as device identifiers, operating system information, and usage data, to operate, maintain, and improve the App's functionality and user experience.

Additional Data We Collect

In addition to the above, we collect the following data in connection with specific features of the Services:

• Sweepstakes entry data: When you participate in Sweepstakes Promotions, we collect your opt-in consent records including the consent statement agreed to, timestamp, user ID, device type, and entry activity data for each drawing period.
• Winner data: If you are selected as a potential prize winner, we collect your full name, mailing address, and government-issued photo identification for prize fulfillment and eligibility verification purposes. For prizes requiring tax documentation, we collect your Social Security Number or Tax Identification Number.
• Location data: When you initiate a deal redemption, we collect your device's precise GPS location data solely to verify physical presence at the merchant location. See Section 5 for full details.
• Referral data: If you enter a referral mobile number in your profile, we collect that number solely to credit sweepstakes entries to the referring user. This number is used only for referral tracking within the App.
• Subscription data: If you subscribe to Birthday CLUB+, we collect and process subscription status information to deliver applicable benefits. Payment processing is handled by our licensed third-party payment processor.

3. USE OF COLLECTED DATA

We use the personal information we collect to operate, maintain, and improve The Birthday CLUB mobile application and to deliver its core functionality. Specifically, we may use your information to:

• Create and manage your account and enable access to the App
• Verify account uniqueness, maintain account integrity, and prevent duplicate registrations
• Deliver birthday-related and promotional offers available within the App
• Communicate with you regarding your account, including service related or transactional notifications
• Respond to user inquiries, requests, or support needs
• Monitor usage trends and improve App performance, features, and user experience
• Administer Sweepstakes Promotions including recording opt-in consent, tracking entry activity, selecting winners, and fulfilling prizes in accordance with applicable Official Rules and legal requirements
• Deliver Birthday CLUB+ subscription benefits and manage subscription status through our licensed third-party payment processor
• Verify physical presence at merchant locations at the time of deal redemption through device location services
• Track referral activity to credit sweepstakes entries to referring users
• Comply with applicable legal, regulatory, and contractual obligations including IRS tax reporting requirements for prize winners

Your mobile phone number is used for internal account-related purposes such as account verification and integrity controls. We do not send marketing or promotional text messages unless you have explicitly opted in to receive SMS communications, and you may opt out of such messages at any time by replying STOP to any message received.

We do not use personal information for cross-app tracking, targeted advertising, or sale to third parties.

4. ACCESS TO PERSONALLY IDENTIFIABLE INFORMATION

In addition to messages sent to users directly from The Birthday CLUB, we provide access to your personally identifiable information (name, email, birthday month and day, mobile number) only to those Advertisers whom you patronize by redeeming a deal available in the App at checkout to complete a sales transaction. We provide this non-financially sensitive marketing data to advertisers to aid in reconciliation controls to help prevent redemption abuse. Although unlikely, advertisers may use this marketing information to send you information about offers and services they feel would be of interest to you outside of the App. You can elect to stop receiving communications directly from participating advertisers by unsubscribing from messages received directly from the communicating advertiser.

Location data collected at the time of deal redemption is not shared with advertisers. Location data is used solely for redemption verification purposes as described in Section 5 of this Privacy Policy.

Sweepstakes winner data including government-issued photo identification and tax identification numbers are not shared with advertisers or third parties except as required by applicable law, including IRS reporting obligations.

5. LOCATION DATA

The Birthday CLUB collects your device's precise GPS location data solely at the moment you initiate a deal redemption within the App. Location data is used exclusively to verify that you are physically present at the participating merchant location at the time of redemption.

Specifically regarding our location data practices:

• Location data is not collected continuously — it is accessed only at the moment you tap to initiate a deal redemption.
• Location data is not stored beyond the verification transaction.
• Location data is not used for advertising targeting, behavioral tracking, or any purpose other than redemption verification.
• Location data is not shared with third parties except as necessary to complete the redemption verification process.
• Location services permission requests will specify While Using App access only — continuous background location tracking is not requested or used.
• You may decline to enable location services on your device at any time.
• Declining location services will prevent deal redemption entries from being processed but will not affect your ability to use the App, access deals, or participate in Sweepstakes Promotions through other available entry methods.

If location services are disabled on your device and you attempt to redeem a deal, the App will prompt you to enable location services. You may choose to decline this prompt without any impact on your general App access or sweepstakes participation.

6. SWEEPSTAKES PROMOTIONS DATA

When you participate in Birthday CLUB Sweepstakes Promotions, we collect and process the following data:

• Monthly opt-in consent records: timestamp, user ID, device type, and the exact text of the consent statement agreed to at time of entry. This data is retained for a minimum of four (4) years as required for sweepstakes compliance purposes.
• Entry activity data: entries earned through each mechanic (base opt-in, deal redemptions, referrals, merchant views, birthday month multiplier) are logged per user per drawing period.
• Winner notification records: timestamps and delivery status of winner notifications sent via the App.

If you are selected as a potential prize winner, we collect additional information required for prize fulfillment:

• For all prizes: full name, mailing address or digital delivery information, and confirmation of eligibility.
• For grand prizes: valid government-issued photo identification confirming age of at least 18 years, uploaded through the App.
• For prizes where cumulative annual prize value from The Birthday CLUB reaches or exceeds $600: Social Security Number or Tax Identification Number for IRS Form 1099-MISC reporting. This information is collected and processed solely for legal tax reporting compliance and is not used for marketing or shared with third parties except as required by law.

Winner first names and last initials are published within the App and via push notification following prize confirmation. No additional personally identifiable winner information is published publicly.

7. BIRTHDAY CLUB+ SUBSCRIPTION DATA

If you subscribe to Birthday CLUB+, we collect and process the following data:

• Subscription status: active, inactive, or cancelled, maintained within the App to deliver applicable benefits including increased sweepstakes entries and access to exclusive Plus+ member deals.
• Subscription history: billing dates and subscription tier, retained for the duration of your account and for a reasonable period thereafter for billing dispute resolution purposes.
• Payment processing: payment transactions are processed exclusively through our licensed third-party payment processor. The Birthday CLUB does not store credit card numbers or financial account information on its servers.

Birthday CLUB+ subscription data is used solely to deliver subscription benefits, manage billing, and support customer service inquiries related to your subscription. Subscription status may affect your sweepstakes entry allocations as described in the applicable Official Rules.

8. SECURITY

We maintain rigorous security practices to ensure as much as is reasonably possible that the confidentiality of your personally identifiable information is not compromised. The Birthday CLUB has established company-wide security practices for your protection. These practices include but are not limited to firewall security, the use of appropriate encryption technology, and the use of multiple levels of credential security to limit access to data on a need-to-know basis. All contractors and employees are required to familiarize themselves with and abide by these safeguards.

Sensitive data collected in connection with prize fulfillment — including government-issued photo identification and tax identification numbers — is handled with heightened security controls and access restrictions consistent with the sensitivity of this information.

9. MINORS

The Birthday CLUB App is rated for users aged 13 and older consistent with applicable app store age ratings. The App is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided us with personal information, we will take steps to delete such information. Participation in Sweepstakes Promotions and receipt of any prize requires the winner to be at least 18 years of age regardless of general App eligibility. 10. CHANGES TO THE PRIVACY POLICY

Changes may be made to this policy from time to time. You will be notified of substantial changes to this policy by the posting of a prominent announcement on the Site and/or App, by a push notification, by an in-app announcement, and/or by a message sent to the email address or mobile number you have provided in your account settings. 11. NO GUARANTEES

While this Privacy Policy states standards for maintenance of data, and while efforts will be made to meet the said standards, The Birthday CLUB is not in a position to guarantee compliance with these standards in all circumstances. There may be factors beyond our control that may result in disclosure of data. Consequently, The Birthday CLUB offers no warranties or representations as regards maintenance or non-disclosure of data.
