Introduction

Loyal Patron LLC (DBA The Birthday CLUB) takes your right to privacy seriously, and wants you to feel comfortable using our service, website and mobile app and providing your contact information. This privacy policy deals with personally identifiable information (referred to as “data” below) that may be collected from you. This policy does not apply to other entities that are not owned or controlled by The Birthday CLUB, nor does it apply to persons that are not employees or agents of the app administrator, or that are not under the app administrator’s control. By downloading the app and creating an account you confirm that you have read, understand and agree to this Privacy Policy & Terms of Service which will constitute a legally binding agreement between us ("Agreement") and that your usage shall conform to this Agreement.

1. Collection of Data

Registration or submission requires your name, a valid e-mail address, valid mobile phone number and birthday month and day. You are not required to provide any other information if you do not want to. Participation in The Birthday CLUB app is limited to one individual per account (unique user). You agree to provide only true and accurate information when signing up for the app or updating personal information at all times. 

Please be aware that the email address you provide and any other information you enter may render you personally identifiable, and may possibly be displayed on this app intentionally during a login session (depending on choices you make during the registration process, your configured notification settings or depending on the way in which the app is configured) or unintentionally (subsequent to a successful act of intrusion by a third party). As on many apps and web sites, the app administrator may also automatically receive general information that is contained in server log files, such as your IP address.

2. Use of Data

The Birthday CLUB may send periodic messages in the form of email, text or in-app notifications according to your opt in notification settings accessible from your user profile settings. Data may be used to customize and improve your user experience on this app that is tailored to your personal interests. We might seek out any information about you that is publicly available on the open market and overlay this data onto ours for comparison purposes to provide the most relevant gift giving, gift receiving and/or money saving celebration opportunities.

Efforts will be made to prevent your data being made available to third parties unless (i) provided for otherwise in this Privacy Policy; (ii) your consent is obtained, such as when you choose to opt-in or opt-out for the sharing of data; (iii) a service provided on our app requires interaction with a third party, or is provided by a third party, such as an application service provider; (iv) pursuant to legal action or law enforcement; (v) it is found that your use of this app violates the app administrator’s policy, terms of service, or other usage guidelines, or if it is deemed reasonably necessary by the app administrator to protect the app’s legal rights and/or property; or (vi) this app is purchased by a third party, in which case that third party will be able to use the data in the same manner as set forth in this policy. In the event you choose to use links displayed on this app to visit other apps or web sites, you are advised to read the privacy policies published on those sites.

3. Access to Personally Identifiable Information (PII) 

In addition to messages sent to users directly from The Birthday CLUB we provide access to your PII (Name, Email, Birthday Month/Day, Mobile) to only those Advertisers whom you patronize by redeeming a deal available in the app at checkout to complete a sales transaction. We provide this non-financially sensitive marketing data to advertisers to aid in reconciliation controls to help prevent redemption abuse of deals The Birthday CLUB makes available to its users. Although unlikely, it is possible advertisers may use this marketing information to send you information about offers and services they feel would be of interest to you outside of The Birthday CLUB app. You can elect to stop receiving email and/or text messages directly from participating advertisers by unsubscribing to messages received directly from the communicating advertiser. 

4. Security

We maintain rigorous Security Practices to ensure as much as is reasonably possible that the confidentiality of your PII is not compromised. The Birthday CLUB has established company-wide security practices for your protection. These practices include, but are not limited to, firewall security, the use of appropriate encryption technology, and the use of multiple levels of credential security to limit access to data on a "need to know" basis. All contractors and employees are required to familiarize themselves with, and abide by, these safeguards.

5. Minors

Although The Birthday CLUB promotes family friendly content the app administrator does not make the app available for download to minors under age 17. For more information, please contact the app administrator.

6. Changes to this Privacy Policy

Changes may be made to this policy from time to time. You will be notified of substantial changes to this policy either by the posting of a prominent announcement on the site, and/or by a mail message sent to the e-mail address you have provided, which is stored within your user settings. You understand the most recent version of this Agreement will be available herein. 

7. NO GUARANTEES

While this privacy policy states standards for maintenance of data, and while efforts will be made to meet the said standards, the app administrator is not in a position to guarantee compliance with these standards. There may be factors beyond the app administrator’s control that may result in disclosure of data. Consequently, the app administrator offers no warranties or representations as regards maintenance or non-disclosure of data.
